Terms and Conditions (Anti-Circumvention Policy)
1. Binding Trip Agreement
Once a driver accepts a trip request from a client on Truck on the Move, both parties enter into a binding agreement to complete the trip within the platform. Cancellation or completion of the trip outside the app to avoid commission is strictly prohibited.
2. Prohibited Conduct
Users (clients or drivers) agree not to:
- Cancel trips after matching for the purpose of completing them outside the app.
- Share contact information with the intention of bypassing Truck on the Move fees.
- Accept or offer trips arranged via the platform but completed privately.
- Engage in any activity that undermines the fair operation of the app or attempts to avoid paying due commission.
3. Commission Avoidance
Attempting to circumvent platform fees by arranging and completing trips off-platform after using Truck on the Move for matching constitutes a breach of these terms. Truck on the Move reserves the right to:
- Suspend or terminate involved accounts.
- Withhold driver payments.
- Charge penalty fees of up to 100% of the estimated commission amount.
4. Cancellation Policy
Cancellations by clients or drivers after a trip has been accepted may result in automatic penalties, including reduced app access or service fees. Repeated cancellations will lead to account review and possible suspension. If a cancellation is due to technical issues or emergencies, users must report it via the app within 1 hour.
5. Payment handling and wallet Usage
Truck OnTheMove integrates a prepaid wallet topped up via PayNow to activate features such as accepting jobs or confirming offers. All payments between users (clients and drivers) occur outside the app and are the sole responsibility of the users. Truck OnTheMove does not process, hold or disburse payments, earnings or transfers between users. The wallet system is strictly for accessing platform features and does not represent funds held in escrow or payment processing.
6. Dispute Resolution
All client payments are held in escrow until the trip is marked as 'Completed' in the app. If a trip is disputed, Truck on the Move will review GPS logs, messages and ratings before resolving the issue. Drivers who fail to complete the trip via the app may forfeit payment.
7. Fraud and Abuse
Truck on the Move may monitor trip activity, GPS tracking, communication patterns and account history for signs of fraud. Any misuse may result in:
- Suspension of platform access
- Withholding of funds
- Legal action for breach of contract
8. Termination
Truck on the Move reserves the right to permanently ban any user who:
- Repeatedly cancels trips without valid cause
- Attempts to complete app-arranged trips privately
- Has a history of suspicious activity related to commission avoidance
